Understanding Possible FMCSA Violations in the NM Greyhound Bus Crash

Since trucking is an interstate business, meaning it crosses many state lines, there is a need to have one governing body of law applicable in each state. This is because each state may have different requirements and obligations of truck drivers and trucking companies, or some may not have any. The Federal Motor Carrier Safety Administration, or FMCSA, is a federal agency which promulgates federal regulations applicable to truck drivers and trucking companies. A violation of these regulations may be helpful for a victim to use to establish evidence of negligence against the truck driver and trucking company in a personal injury lawsuit. Our New Mexico trucking accident lawyer is experienced with FMCSA violations and has the knowledge and skill to wield FMCSA violations in your favor.

There are several possible FMCSA regulations which may apply to the New Mexico Greyhound bus crash. Some of the most applicable regulations are the following:

  • Governing propriety and integrity of tires: 49 CFR section 393.75 (a),”[n]o motor vehicle shall be operated on any tire that-
  1. Has body ply or belt material exposed through the tread or sidewall,
  2. Has any tread or sidewall separation,
  3. Is flat or has an audible leak, or
  4. Has a cut to the extent that the ply or belt material is exposed.”
  • Governing responsibility of checking tires: 49 CFR section 392.7 (a), “[n]o commercial motor vehicle shall be driven unless the driver is satisfied that following parts and accessories are in good working order . . . tires.” The particularly includes a truck driver being required to check “wheels, rims, lugs, tires” before they go onto the road.
  • Hours of service violations on the maximum amount of time to work: Part 395.
  • Ill or fatigued truck drivers that cannot react quickly to hazards (like a blown tire) – 49 CFR section 392.3.
  • Use of illegal drugs or other substances, including to stay awake: 49 CFR section 392.4.
  • Trucking routes and schedules must comply with speed limit: 49 CFR section 392.6.
