  • Under NM Stat. section 41-2-3, a personal representative must be appointed to represent the child whom is killed in the crash which is likely to be a surviving parent, or if both pre-deceased, a legal guardian, adult sibling, grandparent, aunt/uncle, great grandparent, or another individual the court deems proper.
