New Mexico Law and Drunk Driving

Both under New Mexico common law, or judge made law, and statutory law, drunk driving is illegal and can result in a finding of negligence against a drunk driver.  Under NM Stat. 66-8-102, it is illegal to operate a motor vehicle while under the influence of alcohol under these conditions:

  • if you are under 21 years old, it is illegal to drive with a blood alcohol concentration of .02 or more;
  • if you are driving a commercial vehicle like a tractor trailer, it is illegal to drive with a blood alcohol concentration of .04 or more;
  • if you are over 21 years old, it is illegal to drive with a blood alcohol concentration of .08.

When a New Mexico car accident occurs because a driver is coming from a holiday party intoxicated, a victim’s entire life can be affected.  Unfortunately, because it is the holidays, victims of New Mexico car accidents tend to be entire families on their way home from their own festivities.  This completely destroy an entire family all because someone had a few too many beers and decided to drive.
