News Reports of Fatal I-25 Accident Near Isleta Blvd in New Mexico

There has been a fatal I-25 accident near Isleta Blvd in New Mexico, according to many Albuquerque, New Mexico news sources. There is little information about how the accident occurred other than it was a two-vehicle collision and one woman was killed, another victim’s arm was severed, and a third person was rushed to a local hospital. The stretch of road was closed for a point and has since been reopened. Police are still investigating what happened in the collision and how it occurred. There has been no update on the condition of the victims injured in the crash.

Here at the Caruso Law Offices, P.C., our entire law firm extends its condolences to the families of those tragically killed and seriously injured in this motor vehicle accident. We understand how difficult it is after serious or catastrophic personal injuries, including those due to the negligence of another person. While we do not know anything about liability or who may be at fault, all we can do is explain what potential issues may arise. But what is most important, the we can also advise families and victims that we are here to help and listen to their stories, injuries, and what possible rights they may have under New Mexico law during a FREE consultation.

Rights of Passenger

There were two vehicles and three victims who were either killed or injured. This means at least one person was a passenger, if there were not other passengers in the vehicles and who were unarmed. A passenger has superior rights in a motor vehicle accident because they almost always do not have any comparative fault for contributing to or causing the motor vehicle accident. This means that a passenger is likely to have what is known as a “full liability” case, meaning they will get the face value of their injuries without any discount for comparative fault on their part.

Fatal Injuries to Female Victim

When it comes to the individual who was tragically killed, it is unclear what vehicle or role this individual played in the motor vehicle accident. What is important for the victim’s family to realize is that they will need to get a personal representative appointed in order to pursue the victims rights under New Mexico law. This is usually done through at least limited letters testamentary.

Whether the victim was not at fault or partially at fault for the motor vehicle accident, the victim’s family may be entitled to compensation for the following:

  • Pain and suffering before passing
  • Medical bills
  • Lost wages
  • Loss of income support for the family
  • Burial expenses
  • Funeral expenses
  • Loss of guidance, society, and consortium with family members
  • Punitive damages in rare but exceptional cases in New Mexico, and
  • Other damages related to the wrongful death.

Victim Suffering the Loss of a Limb

The loss of a limb is a very serious type of personal injury that a victim of a New Mexico auto accident could always seek compensation for—even if they are unsure if they were the partial cause of an action or the injuries. This is because the loss of a limb is permanent disability and may require assistance with daily care, including physical therapy or occupational therapy.

There is an obviously physical loss with a loss of a limb, but there is also a serious emotional or financial loss too. Victims who lose a limb may offer from a condition known as phantom limb syndrome when the victim’s brain still thinks the limb is attached and it is causing pain, discomfort, and distress. Other victims are common suffering from depression, anxiety, stress, and other emotional harm is common.
